Terms of Service

1. Acceptance of Terms
By accessing or using Commune (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. The Service
Commune is a "Headless Social Network" that allows newsletter creators to generate a community space for their subscribers. We provide the infrastructure (the "Town Square"), but we do not create the content.
3. Beta Access
- "As Is" Basis: You acknowledge that Commune is currently in Beta. The Service may contain bugs, errors, or experience downtime.
4. User Accounts & Responsibilities
- Security: You are responsible for maintaining the security of your account and API keys.
- API Usage: You agree not to abuse the API limits or attempt to scrape data from the Service.
5. Content & Ownership
- Your Content: You retain full ownership of your newsletter archives and subscriber lists. Commune claims no intellectual property rights over the material you sync from your ESP.
- License to Us: You grant Commune a limited, non-exclusive license to display, host, and reproduce your content solely for the purpose of operating your community space.
- ESP Integrations: By connecting an ESP, you authorize Commune, acting as your Data Processor, to import and store your subscriber contact details (including email addresses) to power your community space, and you warrant that you have the lawful basis to share them with us for this purpose.
- AI crawlers: Your public community pages declare a content signal of "search=yes, ai-input=yes, ai-train=no". Search engines and AI assistants may index that content and cite it when answering someone's question, which sends readers back to you. We do not grant permission to use it as training data. This is a stated preference rather than a technical control, so we cannot stop a crawler that chooses to ignore it. Anything behind a login or a subscriber gate is excluded, because it is never served to a crawler in the first place.
- Community Guidelines: You are responsible for moderating your community. However, Commune reserves the right to remove content or ban communities that promote hate speech, violence, illegal activities, or harassment. We stand for the Open Web, but not for abuse.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease, and we will delete your synced data.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Commune shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data (including subscriber lists), or goodwill.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be resolved in the courts of Badajoz, Spain.
